These Terms and Conditions set out the basis on which we provide waste collection services in Kentish Town and surrounding areas. By making a booking, accepting a quotation or allowing our operatives to start work at your premises, you agree to be bound by these Terms and Conditions. Please read them carefully before using our waste collection services.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Service means the waste collection, removal, transportation and disposal services that we provide to you.
We, us, our means the waste collection service provider operating in Kentish Town.
You, your means the customer, being any individual, business, landlord, tenant or organisation that books or receives our services.
Booking means a confirmed request for our services made by you via telephone, email, online form or in person.
Waste means the items, materials, rubbish, refuse or other substances that you ask us to collect and remove, subject to applicable laws and restrictions.
Premises means the property or location at which we provide the services.
2. Scope of Service
We offer waste collection services which may include the collection, loading, transportation and lawful disposal of domestic, commercial and other permitted waste from premises in and around Kentish Town. Our services are provided on a one-off or recurring basis, as agreed at the time of booking.
The precise scope of the services, including the type and volume of waste to be collected, the location, timing and any special requirements, will be agreed with you at the time of booking or as part of an agreed quotation.
We reserve the right to refuse collection of any waste that is hazardous, prohibited, unsafe to handle, illegal to transport or dispose of, or which in our reasonable opinion poses a risk to health, safety, property or the environment.
3. Booking Process
You may request a quotation or make a booking for our Kentish Town waste collection services by contacting us via our published contact channels. When making a booking, you must provide accurate and complete information, including:
The address of the premises and any access details.
The type and approximate quantity or weight of waste.
Any large, heavy or unusual items requiring special handling.
Preferred dates and times for collection.
Any relevant parking or loading restrictions.
We may provide an estimated price based on the information you provide. This estimate may be subject to change if, upon arrival, the actual volume, weight or nature of the waste differs from what was originally described, or if access is more restricted than indicated.
Your booking is not confirmed until we have accepted it and provided you with confirmation, which may be given verbally or in writing. We reserve the right to decline any booking at our discretion.
4. Access and Customer Responsibilities
You are responsible for ensuring that we have safe, suitable and timely access to the premises and to the waste to be collected. This includes:
Ensuring someone authorised is present at the agreed time, if required.
Providing accurate instructions on how to access the site or building.
Ensuring the waste is reasonably grouped or located where it can be safely loaded.
Arranging any necessary permits or permissions for parking or loading where applicable.
If we are unable to gain access, if there are unreasonable delays caused by you or your representatives, or if the waste is not available as described, we may charge a wasted journey fee or a reasonable waiting charge. We are not responsible for any delay or inability to provide the service where this is caused by circumstances outside our reasonable control or by your failure to meet your obligations.
5. Pricing and Quotations
Prices for our waste collection services are normally based on factors such as volume, weight, type of waste, labour required, access conditions and disposal costs. Any quotation we provide is based on the information given at the time and is an estimate only, unless we expressly state that it is a fixed price.
We reserve the right to revise our quotation or charge additional fees if:
The waste differs significantly in nature, volume or weight from that originally described.
Access to the premises is more difficult or time-consuming than reasonably expected.
Additional services are requested or required on site, such as dismantling bulky items.
Disposal costs increase due to changes in disposal site charges or regulatory requirements.
Where additional charges apply, we will explain the reason and seek your agreement before proceeding, wherever reasonably possible.
6. Payment Terms
Unless otherwise agreed in writing, payment for our services is due on completion of the collection, and in any event no later than the date shown on any invoice we issue. We may require full or partial payment in advance for certain bookings or larger jobs.
We accept payment by the methods notified to you at the time of booking. All charges are stated exclusive of any applicable taxes, which will be added where required by law.
If payment is not received by the due date, we may charge interest on the overdue amount at the statutory rate and may suspend further services until full payment is made. You will be responsible for all reasonable costs incurred by us in recovering overdue amounts, including legal and debt collection fees where applicable.
7. Cancellations and Changes
You may cancel or amend your booking by contacting us as soon as possible. The following terms apply unless we agree otherwise in writing:
If you cancel more than 24 hours before the agreed collection time, no cancellation fee will usually be charged.
If you cancel less than 24 hours before the agreed collection time, we may charge a reasonable cancellation fee to cover our costs.
If our team has already been dispatched or has arrived at the premises and you cancel or are unable to proceed, we may charge a call-out or wasted journey fee.
Any changes to the scope of the service, date, time or location are subject to availability and may result in a revised quotation or additional charges. We will notify you of any such changes before proceeding.
We reserve the right to cancel or reschedule a booking due to operational reasons, adverse weather, vehicle breakdown, staff illness, safety concerns or other circumstances beyond our reasonable control. In such cases, we will notify you as soon as reasonably practicable and will offer a new appointment. We will not be liable for any loss or costs arising from such cancellation or rescheduling, other than refunding any pre-paid charges for services not provided.
8. Waste Types and Regulatory Compliance
All waste collection and disposal will be carried out in accordance with applicable UK waste management legislation, regulations and guidance, including but not limited to duties of care relating to the handling and transfer of waste.
You confirm that you have the right to authorise the removal of the waste from the premises and that the waste presented for collection does not include prohibited or unlawful materials. Such prohibited items may include, but are not limited to, certain hazardous substances, clinical or medical waste, asbestos, pressurised containers, explosives, chemicals, oils, fuels and other regulated items.
We may require you to provide information about the nature and origin of the waste. Where required by law, a waste transfer note or other documentation will be completed, and you agree to provide accurate information to enable us to comply with our legal obligations.
If we discover or reasonably suspect that the waste includes prohibited, hazardous or incorrectly described materials, we may refuse to collect it or may adjust our charges and procedures accordingly. We may also report unlawful waste activities to the relevant authorities where we are legally required or consider it appropriate to do so.
9. Title, Risk and Disposal
Title and liability for the waste pass to us at the point it is loaded into our vehicle, provided that the waste has been correctly described and is lawful for us to carry and dispose of. If it is subsequently found that the waste was not lawfully transferable or was incorrectly described in a material way, responsibility may revert to you and you agree to indemnify us for any resulting loss, cost or liability.
We will transport and dispose of collected waste at licensed or otherwise lawful disposal, recovery or recycling facilities. We aim to minimise the amount of waste sent to landfill where reasonably practicable, in line with applicable regulations and our environmental commitments.
10. Damage and Liability
We will exercise reasonable care and skill when providing our services. However, you are responsible for protecting or removing any items that may be damaged during the normal execution of waste collection activities, particularly where waste is located near delicate fixtures, furnishings or structures.
We will not be liable for minor damage that is reasonably incidental to the proper performance of the services, such as scuffs or marks arising from the movement of bulky items through confined spaces, provided we have acted with reasonable care.
Our total liability to you in respect of any loss or damage arising out of or in connection with the services shall be limited to the amount paid or payable by you for the particular service giving rise to the claim, except where liability cannot be limited by law. Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other matter where it would be unlawful to do so.
We are not liable for indirect, consequential or economic losses, including loss of profit, loss of business, loss of opportunity, or loss of anticipated savings, whether arising in contract, tort or otherwise, in connection with our services.
11. Customer Indemnity
You agree to indemnify and keep us indemnified against all claims, costs, damages, fines, penalties and expenses arising from:
Your breach of these Terms and Conditions.
Your failure to accurately describe the waste.
Your failure to obtain any necessary consents or permissions for waste removal.
Your provision of waste that is illegal, hazardous or not permitted for collection or disposal.
This indemnity will extend to any third-party claims, regulatory actions or enforcement measures arising from the matters above, except to the extent that such claims arise directly from our own negligence or wilful misconduct.
12. Data Protection and Privacy
We may collect and process personal information about you in order to manage bookings, deliver our services, process payments and comply with legal obligations. We will handle your personal data in accordance with applicable data protection laws in the United Kingdom.
Your information will be used only for legitimate business purposes connected with the provision of waste collection services and may be shared with third parties such as payment processors, insurers or regulatory authorities where necessary and lawful.
13. Complaints and Dispute Resolution
If you are unhappy with any aspect of our services, please contact us promptly with details of your complaint. We will aim to investigate and respond within a reasonable timeframe and to resolve issues where possible.
If a dispute cannot be resolved through our internal complaints process, either party may pursue any rights or remedies available under applicable law. Nothing in these Terms and Conditions affects your statutory rights.
14. Variations to Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in our services, in relevant laws or in business practices. Any revised terms will be made available to you and will apply to bookings made after the date on which the revised terms come into effect.
The version of the Terms and Conditions in force at the time of your booking will normally apply to that booking, unless a change is required by law or you agree otherwise in writing.
15. Severability
If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable by a court or competent authority, that provision will be severed from the remaining terms, which will continue in full force and effect.
16. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of England and Wales.
You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions, the services or their subject matter.
By proceeding with a booking or using our waste collection services in Kentish Town, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
